The Legge Gelli-Bianco makes documented adherence to published guidelines a condition of criminal non-punishability. For tattoo, piercing, and permanent makeup, no national law exists — regulation is entirely regional, with major differences across the 20 regions. This guide summarizes the applicable laws, enforcement bodies, and penalties — from dental practices to tattoo studios.
In Italy, sterilization obligations apply to every profession that uses reusable instruments penetrating the skin or contacting mucous membranes. Dental practices must comply with D.Lgs 81/2008 Title X (Art. 274), the ISPESL Linee Guida of May 2010, and UNI/TR 11408:2011 — the full reprocessing chain, from decontamination to traceability. Tattoo, piercing, and permanent makeup have no specific national law: they are regulated by the laws of the 20 Regioni — Lombardia L.R. 13/2021 (with DGR XI/5796), Toscana L.R. 28/2004 (DPGR 47R/2005), Lazio L.R. 2/2021, Piemonte, and others — with the 1998 Ministry of Health Circulars as the (non-binding) national reference. Podologists, recognized as a healthcare profession under D.M. 666/1994 and registered with the Albo FNO TSRM e PSTRP, are subject to the same D.Lgs 81/2008 obligations as dental practices.
The principle is the same across professions: any instrument that penetrates the skin barrier or contacts mucous membranes must be single-use and sterile, or sterilized in an autoclave before each use.
The European standard EN 13060, adopted in Italy as UNI EN 13060, defines the requirements for the small steam sterilizers used in clinics and studios. It distinguishes three classes of autoclave: N (solid, unwrapped instruments), S (specific cycles defined by the manufacturer), and B (the most versatile — hollow instruments, wrapped loads, textiles). Class B with fractionated pre-vacuum is mandatory for dental practices that sterilize hollow instruments (turbines, contra-angles, handpieces) and is the standard professional choice for podiatry, tattoo, piercing, and permanent makeup as well.
For the traceability methodology of the reprocessing chain, UNI/TR 11408:2011 is the technical reference document, completed by UNI EN ISO 17665-1 for performance qualification of moist-heat sterilization processes and UNI EN 556-1, which defines sterility as a Sterility Assurance Level ≤ 10⁻⁶.
Dental — ASL and Albo: the ASL (Azienda Sanitaria Locale) is the inspection authority — in Lombardia: ATS (Agenzia di Tutela della Salute). Inspections may be planned or unannounced. D.Lgs 81/2008 and the ISPESL Linee Guida 2010 are the operational references at the national level. FNOMCeO (National Federation of Orders of Physicians and Dentists) coordinates the provincial Orders, and registration with the Albo degli Odontoiatri at the provincial CAO (Commissione Albo Odontoiatri) is mandatory.
Tattoo, piercing, and permanent makeup: regulated at the regional level — each of the 20 Regioni may have its own law. The most structured regional laws include: Lombardia L.R. 13/2021 + DGR XI/5796 (1,500 total training hours, mandatory Class B autoclave, dedicated sterilization area ≥4m²), Toscana L.R. 28/2004 + DPGR 47R/2005 (600 training hours), Lazio L.R. 2/2021 (800 hours tattoo, 300 hours piercing), Piemonte (94–700 hours depending on activity). Registration requires SCIA (Segnalazione Certificata di Inizio Attività) with the Comune, plus where required, notification to the competent ASL. ARPA (Regional Environmental Protection Agency) verifies compliance of inks with EU Reg. 2020/2081 (REACH).
Podiatry: the FNO TSRM e PSTRP (Federazione Nazionale degli Ordini dei Tecnici Sanitari di Radiologia Medica e delle Professioni Sanitarie Tecniche, della Riabilitazione e della Prevenzione) manages the Albo dei Podologi. Registration is mandatory to practice. The podiatry practice is subject to the same D.Lgs 81/2008 and ISPESL Linee Guida that apply to all healthcare facilities.
During an ASL inspection, the inspector verifies: a written reprocessing protocol approved by the practice owner (titolare dello studio, the legal employer under D.Lgs 81/2008); traceability records for every cycle with validated parameters (temperature, pressure, time, result); the daily steam-penetration tests (Bowie-Dick or Helix for prevacuum autoclaves, before the first load); Class 1 chemical process indicators (UNI EN ISO 11140-1) on every package; the regular biological controls using Geobacillus stearothermophilus spores at intervals defined by risk analysis; that sterilized packages carry the lot number, sterilization date, and use-by date; a dedicated reprocessing area with one-way workflow; autoclave maintenance records; documented staff training; retention of records for 5–10 years depending on regional directive.
D.Lgs 81/2008 (Art. 55 et seq.): variable administrative penalties for violations of biological-risk obligations, including failure to implement adequate sterilization. Penalties range from fines to imprisonment depending on severity.
Legge Gelli-Bianco (Law 24/2017), Art. 590-sexies of the Criminal Code: criminal liability for injury or death due to professional negligence. Non-punishability applies ONLY when the published guidelines were followed and documented. Without documentation, non-punishability does not apply. Article 7's dual liability — contractual for the struttura sanitaria (10-year prescription) and extracontractual for the practitioner (5-year prescription) — exposes both the practice and the individual operator.
Tattoo, piercing, and permanent makeup: regional penalty examples: Lombardia L.R. 13/2021 sets fines from €3,000 to €15,000 plus immediate closure (operating without qualifications) or suspension (hygiene violations). Lazio L.R. 2/2021 and Piemonte have similar structures. The ASL may order practice closure for serious hygiene violations.
Podiatry: as a regulated healthcare profession, the podiatry practice is subject to the same inspections and penalty regime. The Ordine may also open disciplinary proceedings for breaches of professional ethics.
