Instrument sterilization is a legal obligation for many professionals in France. This guide summarizes the applicable laws, enforcement bodies, and penalties.
In France, several categories of professionals are required to sterilize their instruments. Tattoo artists, piercers, and permanent makeup practitioners are governed by Decree n2008-149 of 19 February 2008. Dentists fall under the French Public Health Code (Art. R.4127-204 and Art. L.5212-1) and DGS circulars. Podiatrists are subject to Art. R.4322-77 of the Public Health Code and recommendations from the ONPP (Ordre National des Pedicures-Podologues -- podiatry regulatory body).
The principle is the same for all: any instrument that penetrates the skin barrier or comes into contact with mucous membranes must either be single-use and sterile, or sterilized in an autoclave before each use.
Standard NF EN 13060 defines the requirements for small steam sterilizers used in clinics and studios. It distinguishes three autoclave classes: N (solid, unwrapped instruments), S (specific cycles defined by the manufacturer), and B (the most versatile -- hollow instruments, wrapped loads, textiles). Class B is recommended by the ONPP for podiatry and is considered the benchmark for all professionals.
The autoclave must undergo regular validations: a daily Bowie-Dick or Helix test before the first load, and biological controls (spore indicators) at regular intervals.
In France, the ARS (Agence Regionale de Sante -- Regional Health Authority) inspects tattoo, piercing, and permanent makeup studios. It can carry out unannounced inspections and order the suspension of activities in the event of non-compliance.
The ONPP (Ordre National des Pedicures-Podologues -- podiatry regulatory body) oversees sterilization compliance in podiatry practices. The CPAM (national health insurance fund) may also audit practices in the context of podiatric care reimbursement (particularly for diabetic patients).
The Order of Dental Surgeons and the ARS jointly inspect dental practices. Dental centres have been subject to increased oversight since 2022.
During an inspection, the inspector verifies: autoclave compliance (class, validation, maintenance), cycle traceability (complete register with date, time, parameters, instrument-to-patient link), passage indicators and biological controls, use-by dates (DLU) on pouches, medical waste (DASRI) management, and staff training (hygiene and sanitation certification for tattoo artists/piercers/PMU practitioners, continuing education for healthcare professionals).
For tattoo artists, piercers, and PMU practitioners: a class 5 offence (up to 1,500 EUR per violation, 3,000 EUR for repeat offences), and suspension of activities by the ARS.
For dentists: disciplinary sanctions from the Order, criminal prosecution, fines of up to 80,000 EUR (Vincennes Dental Centre precedent, 2025), and suspension of activities.
For podiatrists: disciplinary sanctions from the ONPP, consequences on CPAM reimbursements, and criminal prosecution in the event of patient harm.
